PREAMBLE

Respecting your privacy and your personal data is a priority for LANDEMA. This Personal Data Protection Charter covers the processing of data related to the management of the website, which includes all web pages, computer elements and functions offered to users.

In any event, LANDEMA undertakes to respect the following two (2) essential principles:

You remain in control of your personal data;
Your data is processed in a transparent, confidential and secure manner.
The processing of personal data is governed :

Law no. 78-17 of 6 January 1978 on data processing, data files and individual liberties;
By Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, which came into force on 25 May 2018 (hereinafter "GDPR").


1. DATA CONTROLLER

LANDEMA, whose registered office is located at 2760 route de Bélis, 40420 Le Sen, is responsible for the data processing detailed in this Personal Data Protection Charter.

2. PURPOSES AND LEGAL BASIS

Your various data may be collected by LANDEMA in order to ensure :

Legal obligation

The processing of your personal data is the subject of processing sheets which are included in LANDEMA's processing register.

The provision of the data collected for processing operations whose legal basis is the contract is compulsory in order to ensure the performance of contracts (opening of an online account, purchase of products, etc.). Failure to provide this data will prevent the proper performance of the commercial service.

3. CATEGORIES OF DATA

LANDEMA only collects the following information:

Data relating to your identity (e.g. title, surname, first names, address, telephone number, e-mail address, etc.)
Professional contact data (e.g. professional e-mail address, professional telephone number)
Data relating to payment methods and invoicing
Data relating to the follow-up of the commercial relationship (e.g. order history)
Data relating to your browsing on our site via cookies and connection logs (e.g. IP identifier).
No data is collected from publicly accessible sources.

4. DATA RECIPIENTS

Only the persons mentioned below may have access to your personal data:

Authorised personnel of the various departments of LANDEMA and the Biolandes Group (authorised personnel of the marketing, sales, administrative, logistics and IT departments, in charge of handling customer relations and prospecting, and in charge of control);
Companies responsible for hosting and maintaining this website and associated software;
Ancillary service providers (service providers, banks);
Where applicable, the relevant courts, mediators, chartered accountants, statutory auditors, lawyers, bailiffs, debt collection agencies;
Third parties likely to place cookies on your terminals (computers, tablets, mobile phones, etc.) when you give your consent (For more details, consult our Cookie Management Charter here.
In the event of the transfer of User Data to a subsidiary of the Biolandes Group or to a third party located outside the European Union, LANDEMA ensures that the recipient country has been the subject of an adequacy decision by the European Commission. If this is not the case, LANDEMA undertakes to ensure that the transfer is governed by the appropriate legal instruments, in particular the Standard Model Contractual Clauses of the European Commission.

5. DATA RETENTION PERIOD

LANDEMA undertakes to ensure that the data collected is kept in a form that enables you to be identified for no longer than is necessary for the purposes for which the data is collected and processed.

Management and follow-up of your contracts, orders and invoices

Your data is kept for the duration of the contract and for up to 5 years after the end of the contract for the purposes of proof.
Your invoices and accounting data are kept for 10 years from the end of the financial year for accounting purposes.
Bank details: Your payment details are deleted once the transaction has been completed, then archived/stored for thirteen (13) months after the transaction date. Landema does not store credit card details.

Data relating to contact requests by post or via the Site form: 3 years from the last contact.

Management of commercial prospecting by e-mail: 3 years from the last contact with the person concerned (e.g.: e-mail sent, telephone call or click on a hypertext link contained in an e-mail).

Customer management: 3 years from the end of the commercial relationship or the last contact with the person concerned (e.g. sending an e-mail, making a telephone call or clicking on a hypertext link contained in an e-mail).

Your identity documents :

1 year if you exercise your right of access or rectification,

3 years if you exercise your right to object.

Your logs which enable us to visualise your activity, anomalies or events linked to security: 6 months maximum.

6. YOUR RIGHTS

In accordance with the Data Protection Act and the RGPD, you have the following rights:

Right of access, rectification, updating and completion of your data,
The right to block or delete your personal data if it is inaccurate, incomplete, ambiguous, out of date, or if its collection, use, communication or storage is prohibited,
The right to withdraw your consent at any time,
the right to limit the processing of your data,
the right to object to the processing of your data,
The right to the portability of the data you have provided to us, where your data is subject to automated processing based on your consent or on a contract,
The right to determine what happens to your data after your death and to choose whether or not we pass on your data to a third party that you have previously designated.
In the event of your death and in the absence of any instructions from you, we undertake to destroy your data, unless its retention is necessary for evidential purposes or to comply with a legal obligation.

If you are not satisfied with the processing of your request, you can then send a letter to LANDEMA - Réclamation RGPD Landema - 2760 route de Bélis, 40420 Le Sen, giving your contact details (surname, first name, address) and a legitimate reason where this is required by law (in particular in the event of opposition to processing).

If you feel that LANDEMA is not giving you satisfaction, you may at any time lodge a complaint with the French personal data protection authority (the CNIL) via its website: https://www.cnil.fr/.

7. SECURITY AND CONFIDENTIALITY

LANDEMA and any of its subcontractors undertake to implement all technical and organisational measures to ensure the security of our processing of personal data and the confidentiality of your data, in accordance with the French Data Protection Act (Loi informatique et Libertés) and the European Data Protection Regulation (RGPD) and Law no. 2018-133 of 26 February 2018 "containing various provisions adapting to European Union law in the field of security".

In this respect, LANDEMA takes the necessary precautions, with regard to the nature of your data and the risks presented by our processing, to preserve the security of the data and, in particular, to prevent it from being distorted, damaged, or accessed by unauthorised third parties (physical protection of premises, authentication process for our customers with personal and secure access via confidential identifiers and passwords, logging of connections, encryption of certain data...).

8. UPDATING OF THE POLICY

This Policy may be updated on a regular basis in order to take account of changes in the Regulations relating to Personal Data.
